The Notary

All purchases in Spain are completed in the presence of an official Notary, where the title deeds (escritura) are signed over from the vendor to the purchaser. The appointment will be made by the agent or the lawyer (by mutual agreement) or on the date of the completion as stated in the purchase contract. VillaMia and your lawyer are also present as well as a bank representative if closing a mortgage.

There will be lots of documents to review and sign, and this isn’t meant to give you a play-by-play description of all of that. We will discuss this before we go to the notary.

But here are a few things you should do before you head to the closing table:

  • Make sure to bring all extra keys, garage door fobs, alarm codes, etc. with you to
    the notary to give to the buyer.
  • Most likely, all of your closing costs will be paid out of the equity in your home.
  • Bring the proper identification, usually a photo I.D. (like your passport), NIE, and/or
    birth certificate.
  • A rested wrist! (you’ll be signing a lot of documents!)
