New regulations concerning tourist rental licences

Tourist licence in Spain

Last month (August 2024), new regulations concerning tourist rental licences were introduced in the Valencian Community, significantly impacting property owners who rent out homes to tourists.

Key updates include:

License Renewal Requirements

Any tourist rental licence granted after August 5th 2024 must be renewed every 5 years. This renewal process involves approvals from both the municipality and the homeowners' association. If you already have a tourist licence it won't need renewing until August 2029.

Not transferrable

When you sell a property with a tourist licence, you can no longer simply do a name change. New owners have to apply for the tourist licence in their own name.

Ban on Partial Rentals

The law now prohibits renting out individual rooms or parts of a property for tourism, making it mandatory to rent the entire unit or rent it for longer. Even if you have a separate self-contained apartment and you live in the main villa, you cannot rent it to holiday makers.

New Responsibility Framework

Property owners are fully accountable for the activities and behaviours of their guests. This includes properly registering each guest and ensuring that the property meets updated habitability standards​.

10 nights' limit

This is unclear at the moment but there seems to be a limit on the number of nights you can rent out your property to holiday makers. Most lawyers had skeleton staff or closed during August so we are sure more details will come out regarding this.

These changes aim to regulate the tourist rental market, ensuring higher quality standards and limiting unfair competition from unlicenced properties. Property owners are advised to stay informed and compliant with these new laws to avoid penalties.

It is also hoped that this will lead to helping local people to be able to afford to rent long-term in the area.

Long-term rentals
